These Terms & Conditions (“Terms”) are a binding agreement between you and IE Yevhen Lomakin, an individual entrepreneur registered in Georgia (“Ciboo”, “we”, “us”, or “our”), and govern your use of the Ciboo mobile application and our website at getciboo.com (together, the “Service”).
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 16 years old to use the Service. By using Ciboo, you confirm that you are 16 or older and that you can form a binding contract with us. If you use the Service on behalf of an organisation, you confirm you are authorised to bind it to these Terms.
2. The Service
Ciboo helps you import and store recipes, plan meals, and create shopping lists, including AI-assisted recipe import and search. We may add, change, or remove features at any time. We aim to keep the Service available but do not guarantee it will be uninterrupted or error-free.
3. Your account
- You are responsible for keeping your login credentials secure and for all activity under your account.
- You agree to provide accurate information and to keep it up to date.
- Notify us at [email protected] if you suspect unauthorised use of your account.
4. Acceptable use
You agree not to:
- use the Service for any unlawful purpose or in violation of any law or third-party right;
- upload or submit content that is illegal, infringing, harmful, or that you do not have the right to submit;
- import content from sources in a way that violates those sources’ terms or applicable copyright law;
- attempt to gain unauthorised access to the Service, other accounts, or our systems;
- interfere with, overload, scrape, or disrupt the Service, or circumvent usage limits, rate limits, or security measures;
- reverse engineer, decompile, or attempt to extract source code, except to the extent this restriction is prohibited by law;
- resell, sublicense, or commercially exploit the Service without our written permission.
We may suspend or terminate accounts that violate these Terms.
5. Your content
- You own your content. You retain all rights to the recipes, images, meal plans, shopping lists, and other content you create or upload (“User Content”).
- Licence to us. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, and display your User Content solely to operate, provide, secure, and improve the Service for you (for example, processing recipe text through our AI providers as described in the Privacy Policy). This licence ends when you delete the relevant content or your account, except for copies retained briefly in backups or as required by law.
- Your responsibility. You are solely responsible for your User Content and for ensuring you have the rights to submit it. Do not upload content that infringes others’ intellectual property or other rights.
6. AI features and no professional advice
Ciboo uses third-party AI to import and search recipes. AI output may be inaccurate, incomplete, or out of date.
The Service does not provide medical, health, nutritional, dietary, or allergy advice. Recipes, ingredient lists, nutritional information, and AI output are for general informational and convenience purposes only. You are responsible for verifying ingredients, allergens, quantities, and suitability for your needs, and for consulting a qualified professional where appropriate. Do not rely on Ciboo to identify allergens or to ensure a recipe is safe for you or anyone else.
7. Subscriptions, payments, and cancellation
Free and Pro plans
Ciboo offers a free plan with limited AI imports (currently up to 5 AI recipe imports per 7-day period, subject to fair-use limits) and a paid Pro plan (offered as a monthly or annual subscription) with additional features such as unlimited AI imports and semantic search. Current features and limits are described in the App and may change.
Free trial
Ciboo offers a free trial of the Pro plan. If you start a free trial:
- the trial lasts for the period shown at the point of purchase (currently 7 days);
- unless you cancel at least 24 hours before the trial ends, the trial automatically converts to a paid subscription (monthly or annual, as selected) and your Apple App Store or Google Play account is charged the then-current price;
- you can cancel at any time during the trial in your Apple App Store or Google Play account settings; cancelling before the cut-off prevents any charge;
- only one free trial may be available per user/account, and trials may not be combined with other offers;
- the specific trial terms presented to you at the point of purchase by Apple or Google govern.
Billing through the app stores
Subscriptions are sold and processed through the Apple App Store or Google Play (via RevenueCat). When you subscribe:
- payment is charged to your App Store or Google Play account;
- subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before the period ends;
- your account is charged for renewal within 24 hours before the current period ends, at the then-current price.
Cancellation and refunds
- You manage and cancel subscriptions in your Apple App Store or Google Play account settings, not directly through us. Cancelling stops future renewals; you keep Pro access until the end of the paid period.
- Refunds are handled by Apple or Google under their respective policies. We generally cannot issue refunds for store purchases directly.
EU/EEA right of withdrawal
If you are a consumer in the EU/EEA, you have a 14-day right to withdraw from a purchase of digital services. Because subscriptions are billed through the Apple App Store or Google Play, this consent and any waiver of the withdrawal right are collected by Apple or Google at the point of purchase: by choosing to start using the paid features immediately, you expressly request that performance begin during the withdrawal period and acknowledge that you lose the right of withdrawal once the service has been fully performed. Where this express consent is not obtained, the 14-day withdrawal right continues to apply. Your mandatory statutory consumer rights are not affected, and refunds remain subject to the stores’ policies.
Price changes
We may change subscription prices. Changes apply to future billing periods and, where required, we will give you advance notice and the chance to cancel.
8. Third-party services
The Service relies on third parties (including Apple, Google/Firebase, RevenueCat, Anthropic, and OpenAI). Your use of the Service may also be subject to those parties’ terms. We are not responsible for third-party services we do not control.
9. Intellectual property
The Service, including its software, design, branding, and the “Ciboo” name and logo, is owned by us or our licensors and is protected by intellectual property laws. Except for the rights expressly granted to you to use the Service, we reserve all rights. You may not use our branding without our written permission.
10. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that AI output or imported content will be accurate.
Nothing in these Terms excludes or limits any rights you have as a consumer that cannot be excluded or limited under applicable law (including mandatory consumer-protection and statutory warranty rights in the EU/EEA and elsewhere).
11. Limitation of liability
Nothing in these Terms limits or excludes our liability where it cannot be limited or excluded by law — including liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or for any other liability that applicable law does not permit to be limited. Your mandatory statutory consumer rights are not affected.
Subject to the paragraph above, and to the maximum extent permitted by law:
- we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill;
- our total liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us for the Service in the 12 months before the event giving rise to the claim, or (b) EUR 50.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
12. Indemnification
To the maximum extent permitted by law, you agree to indemnify and hold harmless IE Yevhen Lomakin (operating as Ciboo) from and against any claims, liabilities, damages, losses, and reasonable expenses (including reasonable legal fees) arising out of or related to: (a) your User Content; (b) your use or misuse of the Service; (c) your violation of these Terms; or (d) your violation of any law or the rights of any third party. We will use reasonable efforts to notify you of any such claim and may, at our option, participate in or control its defence.
This indemnity does not apply to the extent a claim arises from our own negligence or wilful misconduct, and nothing in this section limits or excludes your mandatory statutory consumer rights.
13. Termination
- By you: you may stop using the Service and delete your account at any time from within the App.
- By us: we may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. Where reasonable and lawful, we will give you notice.
- On termination, your right to use the Service ends. Sections that by their nature should survive (e.g., ownership, disclaimers, liability, governing law) will survive.
14. Governing law and disputes
These Terms are governed by the laws of Georgia, without regard to conflict-of-law rules. The courts of Tbilisi, Georgia will have jurisdiction over any dispute, except that, if you are a consumer, you may also benefit from the mandatory protections and the right to bring proceedings in the country where you live, as required by applicable consumer law. We encourage you to contact us first at [email protected] so we can try to resolve any issue informally.
15. Changes to these Terms
We may update these Terms from time to time. We will update the “Last updated” date and, for material changes, provide more prominent notice (such as in the App). Your continued use of the Service after changes take effect means you accept the revised Terms.
